Arbitration and Agricultural Land Tribunal hearings cover
When your margins are squeezed on all fronts, the last thing you want is an excessive level of rent. In an unbalanced relationship the threat of arbitration by your landlord may easily deter you from acting to secure this.
Arbitration and Agricultural Land Tribunal hearings cover puts you and your landlord on equal terms on rental and other disputes under your tenancy agreement.
Where your landlord previously had the upper hand, you will be in a position to enter reasonable negotiations without the risk that the costs involved will exceed the financial benefits to yourself.
Employment disputes and compensation awards cover
Maternity and parental leave, working time directive, minimum wage act, agricultural wages board - with so much new employment legislation every year, it is difficult to keep up to date. Yet being unaware is no defence if a legitimate claim is brought against you. This will help you keep the law on your side.
Specific points of law can be discussed with one of the legal advisers on the free 24-hour legal advice helpline. If a dispute does occur, TFA Farm Business Protector will remain by your side.
It will ensure that you have someone to negotiate prior to, and provide your defence at, an employment tribunal. You may find this reassuring given that, even if you win, your costs are not recoverable under the tribunal system. In addition, providing you follow the advice given, if an award is made against you the insurance will cover it.
Legal defence cover
Businesses are burdened by rules and regulations. The majority follow the format of the Health and Safety at Work Act 1974 whereby either the business itself or an individual director or employee can be prosecuted. With land, buildings and machinery there is the potential for accidents to happen which are beyond your control. Should you, or one of your employees, face prosecution you will, from the outset, receive professional legal advice and representation; the cost of which will have been pre-budgeted with your insurance.
Statutory licence protection
With capital employed, customers to supply and a reputation to maintain, you will want to keep your business operational without hindrance. The TFA Farm Business Protector insurance will cover disputes relating to suspension, alteration, refusal or cancellation of your statutory licence and aim to minimise disruption to your business.
Property protection and bodily injury
Your farm is your livelihood. Unwanted persons can cause damage to livestock, crops and equipment. With property protection cover, you can take action against unwanted persons causing physical damage, trespass or nuisance. Where employees are injured or killed in the course of their normal employment, under bodily injury cover a claim for compensation will be pursued on your behalf.
Cover and cost
Legal and arbitration protection is a cost-effective way of protecting you and your farm against the cost of potential legal disputes.
Members are covered for up to £50,000 in legal costs per claim (£20,000 for end-of-tenancy and Agricultural Land Tribunal disputes) with no limit on the number of claims. TFA Farm Business Protector takes legal action on behalf of members and where necessary appoints solicitors, barristers and expert witnesses.
The policy costs £288.75, inclusive of Insurance Premium Tax, per annum.
